2. Disclaimer / Problems with using external links
Pursuant to Sect. 5 (1) of the Interstate Agreement on Media Services, resp. Sect. 5 of the Teleservice Agreement the LIGA.NRW as a contents provider is liable for "its own contents" it has ready for use. A distinction must be made between its own contents and cross-references (links) to the contents provided by other suppliers. Through these cross-references which are indicated as [] the LIGA.NRW has "third party contents" ready for use. The LIGA can only be held liable for third party contents if they (i.e. also illegal and/or prosecutable contents) have been brought to its knowledge and if technologically the LIGA.NRW is in a position and can be expected to prevent their use (Sect. 5 (2) of the Interstate Agreement on Media Services).

Links are however always "living" (dynamic) references. On the first connection the LIGA has checked third party contents to the best of its knowledge and abilities to determine if it might be held liable for these contents under civil or criminal law. The LIGA.NRW is however not obliged to keep checking the contents referred to on its website for changes, which could provide new grounds for liability. Only when it finds out or is informed by others that a website to which it is providing a link creates liability under civil or criminal law will the LIGA.NRW abandon the link to this website, provided this is technologically possible and reasonable. The technological possibility and reasonableness are not influenced by the fact that even after preventing access to these links from the LIGA.NRW homepage these websites which are liable under civil or criminal law might be accessed from other servers.

3. Copyright and trademark rights
The contents contained within the LIGA.NRW websites are copyrighted. Apart from legally admissible usage, the reproduction, distribution, presentation in public and adaptation of the websites of the www.ephz.de domain for commercial purposes without prior approval of the supplier is explicitly prohibited. If in the individual case no other regulations have been made and as far as third party rights are not concerned, the electronic or printed reproduction, distribution, presentation in public and adaptation of these websites or of isolated elements is only allowed if the source and the URL are acknowledged.

4. Data protection and data security
Storage of access data

Each time a file from our LIGA.NRW websites is requested, access data are stored. Each data set comprises:

the website from which the file was requested
the file name
date and time of the request
the number of bytes transmitted
the access status (file transmitted, file not found, etc.)
a description of the kind of webbrowser used.

Quite deliberately, we refrain from storing the IP address of our visitors. Thus it is not possible to draw up user files. The stored data will only be analysed by the LIGA.NRW as ISP and be used for exclusively statistical purposes; they will not be passed on, even in excerpts, to third parties.

Storage of personal data (orders, e-mails, etc.)

If you send e-mails to the LIGA or place orders with it, the LIGA, as an institution of the State of North Rhine-Westphalia, is governed by the corresponding valid version of the Act on the Protection of Personal Data (Data Protection Act North Rhine-Westphalia - DSG NRW).
